Expert evidence in UK FRAND proceedings (Samsung v ZTE)
Mr Justice Meade handed down his judgment in the FRAND dispute Samsung v ZTE at the High Court of England and Wales. BRELA’s Director Dr Justus Baron acted as an expert witness in this case.
Dr. Baron provided written evidence and was cross-examined at trial. In the judgment, Mr Justice Meade noted that his “views were well reasoned and carefully and precisely presented”, further emphasizing that “the evidence of Dr Baron, by far the most relevantly qualified person, was unanswered by any corresponding expert witness“.
BRELA is committed to the standard of independent, methodologically rigorous expert analysis in complex SEP and FRAND matters through its work in economic and legal analytics.

Latest PUblications
We are pleased to announce the publication of a new study titled “Methodologies for FRAND Determination: Evidence from Global Case Law.”
Published by the European Patent Office (EPO) in collaboration with BRELA Research in Economics and Legal Analytics, the study provides a structured examination of how courts across jurisdictions determine fair, reasonable, and non-discriminatory (FRAND) terms for standard-essential patent (SEP) licensing.
The research assembles one of the most comprehensive global datasets of judicial FRAND determinations to date and analyses the legal and economic methodologies applied in SEP licensing disputes. The study examines key topics including the frameworks and principles guiding FRAND determinations, the use of comparable licences and top-down approaches, the role of patent and market data in apportionment and portfolio valuation, and areas of convergence and divergence across jurisdictions.
By providing a systematic review of global case law, the study contributes to greater transparency and understanding of SEP licensing practices and FRAND valuation methodologies.
